Many cabins on the market around Blue Ridge are already rented by the night, and their listings often lean on that. Here is what actually moves to you at closing and what you have to do yourself.
The certificate can transfer, on a short clock
Fannin County’s ordinance lets a rental certificate transfer when a cabin is sold. The new owner must submit an application within seven days of the sale, pays a $50 transfer fee, and gets a 30-day grace period to keep renting (Fannin County rental ordinance 2025-02). Miss the seven days and you are applying as a new rental, and renting without a valid certificate can bring a fine of up to $1,000 a day (Fannin County rental ordinance 2025-02).
Apply after closing, not before
The county asks buyers not to submit the application until closing is complete, and the application must include a copy of the warranty deed (Fannin County lodging tax page). In practice: have the form filled in before closing day, and file it as soon as the deed is in hand.
What does not transfer
- Your own affirmations. You sign that renting does not violate covenants, deed restrictions or HOA rules, and that you carry short-term rental liability insurance (Fannin County rental ordinance 2025-02). The seller’s policy ends at closing.
- Tax filing. The 6% county lodging tax is filed monthly by the 20th, with a 15% late penalty, even when a platform remits (Fannin County rental ordinance 2025-02).
- The cabin’s condition. The certificate is suspended if the Board of Health finds the septic system has failed (Fannin County rental ordinance 2025-02). Inspect it yourself.
- Future bookings. Guest reservations on the seller’s platform account are a contract question between you and the seller. Put them in writing in the purchase contract.
The checklist for this purchase
Switch on “will be rented by the night” in the checklist builder and it adds every rental item, in order. The full rules are on the rental rules page. Gold Peach Realty’s current Fannin County listings include cabins of every kind.
